Yes, you can technically refuse a field sobriety test. However, that decision is not without consequences. The state of Washington enforces an implied consent law. By receiving a driver’s license, you agree to take a breath or blood test if you are arrested for a DUI. Upon refusal, you will be transported to the police station, where they will do additional testing. Refusing to comply results in an automatic suspension of your license, regardless of whether you are convicted of a DUI or not. Your refusal can also be submitted as evidence of your guilt in criminal proceedings.
Yes. In Washington state, it is illegal to operate a vehicle if your blood alcohol content (BAC) is 0.08 or higher. However, under the law, police officers can judge your impairment on other factors such as erratic driving, slurred speech, or lack of communication. Therefore, if you test under the limit, but the police officer thinks you are “affected by” alcohol or substances, you can still be charged, arrested, and potentially convicted of a DUI.
How long your license is suspended will depend on the severity of your charges and whether or not it is your first offense. For your first DUI charge, the average suspension period is 90 days in Washington State, unless your BAC was over 0.15. In that case, it is an automatic 1-year suspension. Subsequent DUI offenses can result in suspensions of 2 years or more. A reckless driving conviction carries a minimum penalty of a 30-day license suspension. Unpaid tickets could lead to a suspension if you do not address them within the timeframe provided by the court.
